SoCal Rhythm Equipment Rental Terms of Service

This policy covers items and equipment rented for use outside of the SoCal Rhythm factility.

 

1. Introduction

These Terms of Service ("Terms") govern your rental of equipment from SoCal Rhythm ("we," "us," "our"). By renting equipment from us, you ("Customer," "you," "your") agree to these Terms. Please read them carefully.

 

2. Rental Agreement

By agreeing to these Terms, you enter into a rental agreement with SoCal Rhythm for the equipment specified in your order ("Equipment"). The rental agreement begins on the date of the reservation and ends when the Equipment is returned to and accepted by us.

 

3. Eligibility

You must be at least 18 years old and have a valid government-issued ID to rent Equipment from us. By agreeing to these Terms, you confirm that you meet these requirements.

 

4. Rental Period

The rental period begins on the date of the reservation and ends on the date you return the Equipment. You may extend the rental period subject to availability and additional fees.

 

5. Reservations and Payments

    • Reservation: You can reserve Equipment online through our website or in-store.
    • Payment: Full payment is required at the time of reservation. We accept credit cards, debit cards, and other payment methods specified on our website.
    • Security Deposit: We may require a security deposit for certain items. The deposit amount will be specified at the time of reservation and will be refunded upon the return of the Equipment in good condition.

 

6. Cancellations and Refunds

    • Cancellation: You may cancel your reservation up to 48 hours before the rental period begins for a full refund. Cancellations made within 48 hours of the rental period are subject to a 50% cancellation fee.
    • No Show: If you fail to pick up or receive the Equipment, no refund will be issued.

 

7. Delivery and Pickup

    • Delivery: If you opt for delivery, we will deliver the Equipment to the address provided at the time of reservation. Delivery fees apply.
    • Pickup: You may pick up the Equipment from our store during business hours.
    • Return: You are responsible for returning the Equipment by the agreed-upon date and time. Late returns are subject to additional fees.

 

8. Use of Equipment

    • Proper Use: You agree to use the Equipment in a careful and proper manner and comply with all instructions and guidelines provided by us.
    • Prohibited Use: You may not use the Equipment for illegal activities, in a manner that violates any laws or regulations, or in a manner that damages the Equipment.

 

9. Maintenance and Repairs

    • Responsibility: You are responsible for the care and maintenance of the Equipment during the rental period. You must return the Equipment in the same condition as received, normal wear and tear excepted.
    • Damage or Loss: If the Equipment is damaged, lost, or stolen during the rental period, you are responsible for the repair or replacement cost. Your security deposit may be used to cover these costs.

 

10. Insurance and Liability

    • Mandatory Insurance: You must obtain and maintain insurance coverage that includes property damage, loss, theft, and liability for the Equipment during the rental period. Proof of insurance must be provided before the rental period begins.
    • Insurance Coverage: Your insurance policy must cover the full replacement value of the Equipment, as well as any potential liabilities arising from its use.
    • Liability: You agree to indemnify and hold us harmless from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use, misuse, or inability to use the Equipment, whether such claims are made by you, your agents, or any third party.
    • Assumption of Risk: You assume all risks associated with the use of the Equipment. We are not liable for any injuries, damages, or losses that occur during the rental period.
    • Damage or Theft: In the event of damage, loss, or theft of the Equipment, you are responsible for notifying us immediately and providing a copy of the police report if applicable. You are liable for all costs associated with repairing or replacing the Equipment, and your insurance policy must cover these costs.
    • Liability Waiver: By renting Equipment from us, you waive any right to claim against us for any incidental, indirect, or consequential damages, including but not limited to loss of revenue, loss of use, or any other economic loss.

 

11. Security Deposit

    • Collection: A security deposit may be required for certain rentals. The amount will be specified at the time of booking.
    • Refund: The security deposit will be refunded within 7 business days after the Equipment is returned and inspected, less any deductions for damage, loss, or late return fees.

 

12. Default and Termination

    • Default: If you fail to comply with these Terms, we may terminate the rental agreement and repossess the Equipment without notice. You will be responsible for all costs associated with the repossession.
    • Early Termination: We reserve the right to terminate the rental agreement at any time for any reason. In such cases, we will refund the unused portion of the rental fee.

 

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California. Any disputes arising from these Terms or the rental agreement will be resolved in the state or federal courts located in California.

 

14. Amendments

We reserve the right to amend these Terms at any time. The amended Terms will be effective immediately upon posting on our website. Your continued rental of Equipment constitutes acceptance of the amended Terms.
